When you engage an independent contractor to perform work on your behalf, you retain your own duties under the WHS Act and Regulations.
Under WHS safety laws, both the business owner and the contractor share responsibility for safety. You cannot rely solely on the contractor to manage safety risks.
The Primary WHS duty imposed under WHS legislation requires you as an Employer, to take all reasonably practicable steps to protect the health and safety of your employees, contractors and others in the workplace.
As a result, planning to ensure Contractor and Employee safety is important.
It's essential that contractors are aware of the safety procedures in place, understand how these safety procedures work and follow them correctly. Integrating health and safety requirements into contractor procurement and management, and aligning safety systems where practicable, helps prevent contractor safety incidents and fulfills contractor health and safety obligations.
Good contractor safety management is the process that ensures both parties in a contract fully meet their respective obligations as efficiently and effectively as possible, in order to safely deliver both the business and operational objectives required by the contract.
